The threshold of iatrogenesis: Criminal, ethical and administrative responsibility of the novice physician in the Nicaraguan legal framework

Problem definition: In Nicaragua, the newly graduated physician faces a structural dissonance between their clinical training and the legal literacy required for safe professional practice. This cognitive gap, rendered invisible in university curricula, places them in a state of vulnerability to potential criminal prosecution for damages arising from their practice, a phenomenon aggravated by an emerging litigation culture and the social confusion between obligations of means and obligations of results. Methodology: A qualitative investigation was conducted with a hermeneutic-legal and propositional approach. National regulations (Political Constitution, Law No. 423, General Health Law, and Law No. 641, Penal Code) were analyzed in contrast with contemporary criminal dogmatics and Health Law doctrine. Through a phenomenological method, paradigmatic hypothetical cases of lack of skill (imperitia), negligence, omission, and documentary falsehood were deconstructed, selecting doctrinal and jurisprudential sources from the 2000-2025 period. Main results: Evidence shows that, despite the expediency in administrative habilitation (UAM Resolution 005-2008), the general practitioner faces immediate risks of prosecution not only for technical errors but fundamentally for "white-collar" crimes (ideological falsehood) and for encroachment on specialty areas (professional intrusion). The analysis reveals the imperative need to differentiate, from the perspective of criminal dogmatics, the iatrogenic medical fact (inevitable) from the infringement of the objective duty of care (punishable). Conclusions: Subjective good faith does not exempt from criminal liability when an infringement of the lex artis ad hoc is verified. It is concluded that the Nicaraguan penal system sanctions not the harmful result itself, but the creation of a legally disapproved risk. Therefore, the institutionalization of a cross-cutting chair of Preventive Medical Law and Legal Prophylaxis is proposed as a mechanism to transform legal defenselessness into legally safeguarded professional competence and thus mitigate an emerging public health problem.
